This half day course aims to guide practitioners in an overview of complex legal issues related to the welfare and liberty of children and young persons. The course will consider case law, developments and the impact on practice when considering a deprivation of liberty and considers practical issues in its application for children and young people.
Learning Outcomes:
- Decision-Making Principles: Understand the distinction between decision-making for children under 16 (Gillick competence) and young persons aged 16-17 (Mental Capacity Act 2005).
- Understanding Legal Frameworks: Gain knowledge of the legal principles and procedures governing deprivation of liberty for children and young persons under 18
- Application of Article 5 ECHR: Learn how Article 5 of the European Convention on Human Rights applies to deprivation of liberty, including the objective, subjective, and state responsibility elements.
