This half day course aims to guide practitioners in an overview of complex legal issues related to the welfare and liberty of children and young persons. ​The course will consider case law, developments and the impact on practice when considering a deprivation of liberty and considers practical issues in its application for children and young people.

Learning Outcomes:

  • Decision-Making Principles: Understand the distinction between decision-making for children under 16 (Gillick competence) and young persons aged 16-17 (Mental Capacity Act 2005).
  • Understanding Legal Frameworks: Gain knowledge of the legal principles and procedures governing deprivation of liberty for children and young persons under 18
  • Application of Article 5 ECHR: Learn how Article 5 of the European Convention on Human Rights applies to deprivation of liberty, including the objective, subjective, and state responsibility elements. ​
